COURSE OVERVIEW

Mortgage transactions can be complex processes. Because of this, you need to be prepared to resolve issues as they arise.

This course covers your responsibilities and obligations when you act for mortgagees or mortgagors in transactions involving a mortgage of an estate or interest in land. So you can support your clients smoothly throughout the entire procedure.

You’ll learn how to recognise, advise and act on common mortgage transaction issues. 

You’ll examine issues involving:

  • The fundamental principles of land mortgages
  • Your duties as a solicitor in NSW mortgage transactions over land 
  • Discharges, variations and priorities of mortgages
  • Mortgagee’s powers on default 
  • Mortgagor’s defences
  • The professional regulation of mortgage practices 

The course contains content that falls within the mandatory CPD category of Professional Skills.

Note: Since 1 July 2019, all mortgages, discharges of mortgages, refinances or any combination of these must be lodged electronically.
