This course covers your responsibilities and obligations when you act for mortgagees or mortgagors in transactions involving a mortgage of an estate or interest in land. So you can support your clients smoothly throughout the entire procedure.

You’ll learn how to recognise, advise and act on common mortgage transaction issues. 

You’ll examine issues involving:

  • The fundamental principles of land mortgages
  • Your duties as a solicitor in NSW mortgage transactions over land 
  • Discharges, variations and priorities of mortgages

Do you know the ins and outs of leases for commercial properties – as opposed to residential properties?

In this course you’ll learn about what elements make commercial leases distinct entities, covering properties such as shops, factories and offices. 

You’ll gain the skills to process commercial leases on behalf of your clients. You’ll build your confidence to steer them through what’s involved – from preparing to amending to registering the lease.

At the end of this course, you’ll be able to:

  • Advise clients on entering into a commercial lease from the landlord’s (lessor) and tenant’s (lessee) perspectives 
  • Determine whether the Retail Leases Act 1994 (NSW) applies to the transaction 
  • Carry out the steps in a commercial lease – from receiving instructions through to registration 
  • Identify the amendments required to a lease clause 

Note: This course covers leases of land under the Real Property Act 1900 (NSW) (RPA). The terms and conditions of leases of land under the old system title are substantially similar to Torrens Title leases – but there are some notable differences relating to their form, title and registration.

Want to upskill in the strata title system and allow your clients to own part of a building that can be separately titled? 

The most common forms of strata title use have been for multi-storey residential apartment buildings. Yet increasingly, the use of strata title is becoming more diverse. 

Strata schemes can be used for:

  • Freestanding homes usually consisting of no more than two or three lots (for example, three freestanding houses sharing a common driveway and pool)
  • Attached housing – such as townhouses and villas
  • Retail shops
  • Commercial offices
  • Industrial warehouses

This course will provide you with an understanding of fundamental strata concepts; the various forms of strata subdivision; and community, neighbourhood and precinct schemes.

At the end of this course you’ll be able to:

  • Identify common strata title concepts 
  • Draft checklists detailing essential information when preparing a contract for a strata title conveyance
